TERMS AND CONDITIONS

  1. Scope

These Terms apply to purchases of digital music downloads offered through this website. If additional digital products such as sample packs or presets are offered in the future, these Terms shall apply to them unless otherwise stated on the relevant product page.

  1. Products

The shop offers digital products only. No physical shipment takes place.

The specific product category, file format, and essential characteristics of each product are stated on the relevant product page.

  1. Customers

Products may be sold to both consumers and business customers, unless a product page states otherwise.

  1. Conclusion of contract

The presentation of products on the website does not constitute a binding legal offer but an invitation to place an order.

By completing checkout and submitting the order, the customer makes a binding offer to purchase the selected product.

The contract is concluded when the order is accepted, for example by order confirmation, successful payment confirmation, or provision of the download.

  1. Contract language, storage of contract text, and correction of input errors

The contract language is English, unless otherwise stated on the website.

Before submitting an order, the customer can review and correct the information entered during checkout using the available input and navigation functions.

The seller does not separately store the full contract text for retrieval by the customer after conclusion of the contract, unless such storage is technically provided in the checkout system or order confirmation. Order details may, however, be contained in the confirmation email and in transaction records.

  1. Prices and small business status

All prices are shown in the currency displayed on the website.

No VAT is shown, where applicable, because the seller operates under the German Kleinunternehmerregelung.

If the legal tax treatment changes, pricing and tax information may be updated accordingly.

  1. Payment methods

The payment methods available for a particular order are displayed to the customer during checkout. Only the payment methods shown there are available for that transaction.

Payment processing is carried out through the payment provider selected by the customer during checkout.

  1. Delivery

Delivery takes place digitally by direct download after successful payment or according to the checkout flow.

The customer is responsible for:

providing correct purchase information;

using a compatible device and software environment;

securing downloaded files after receipt.

  1. No customer account

At present, purchases are made without customer accounts.

  1. License for music downloads

Unless a product page expressly states otherwise, the purchase of a music download grants the customer a non-exclusive, non-transferable, perpetual license for private and lawful use, subject to these Terms.

The customer may:

download the purchased file for personal use;

store it on their own devices;

use it in private listening;

use it in DJ sets and similar performance contexts;

include it in recorded or streamed DJ mixes only to the extent the customer independently obtains any rights, clearances, or platform permissions that may be required under copyright, neighboring rights, collecting society, platform, or event rules.

The customer may not:

resell the file;

redistribute the file;

share the original file publicly or privately with third parties;

upload the original file to file-sharing platforms, download lockers, sample libraries, or marketplaces;

sublicense, transfer, or assign the purchased file to another person;

claim authorship or ownership of the work.

Purchase of a music download does not transfer copyright or exclusive exploitation rights.

  1. License for sample packs and presets

Unless a product page expressly states otherwise, sample packs and presets are provided under a non-exclusive, non-transferable license.

The customer may:

use the samples or presets in their own music productions;

use them in commercial and non-commercial music created by the customer;

release, publish, distribute, stream, and monetize new musical works created using those samples or presets.

The customer may not:

resell, redistribute, repackage, sublicense, share, or transfer the original sample pack or preset files themselves;

make the original files available as standalone content;

include the original files in another sample pack, preset pack, template pack, or competing product;

claim authorship or ownership of the original files as standalone material.

  1. Intellectual property

All copyrights, neighboring rights, trademarks, and other rights in the products remain with the seller or the respective rights holder unless expressly stated otherwise.

  1. Right of withdrawal for digital content

If you are a consumer, you may have a statutory right of withdrawal for distance contracts.

For digital content not supplied on a tangible medium, the right of withdrawal expires if:

– you expressly consent during checkout that performance begins before the withdrawal period ends; and

– you acknowledge that, by giving that consent, you lose your right of withdrawal once performance begins.

If this consent and acknowledgment are not validly obtained during checkout, the statutory right of withdrawal remains unaffected.

  1. Refund policy

Because the products are digital downloads, refunds are generally excluded once download or access has started, except where mandatory law provides otherwise.

This does not affect statutory rights in cases such as defective or non-conforming digital content.

  1. Defects and support

If a file is defective, corrupted, incorrectly delivered, or inaccessible despite successful purchase, the customer should contact the seller at [email protected] with the order details.

  1. Prohibited conduct

The customer must not misuse the website or products, including by:

fraudulent purchases;

unauthorized copying or redistribution;

attempting to bypass download restrictions or technical protection measures;

using the products in unlawful ways.

  1. Suspension and cancellation

The seller may suspend access, block delivery, or cancel an order where there is a justified suspicion of fraud, abuse, chargeback misuse, or serious breach of these Terms.

  1. Limitation regarding platform and rights compliance

Where customers use music downloads in DJ sets, public performances, livestreams, or recorded mixes, the customer remains responsible for complying with any applicable event, venue, platform, collecting society, licensing, or rights-clearance requirements.

The seller does not guarantee that any third-party platform, distributor, venue, broadcaster, or social network will accept, monetize, or leave online any customer upload or use.

  1. Applicable law

These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods, to the extent legally permissible.

If the customer is a consumer residing in another country, mandatory consumer protection rules of that country remain unaffected where applicable.

  1. Severability

If any provision of these Terms is or becomes invalid or unenforceable, the remaining provisions remain unaffected to the extent permitted by law.
